01 Acceptance of Terms

By accessing or using the website www.aarambh360.com ("Website"), engaging with any of our digital or marketing services, or entering into any business agreement with Aarambh360 / Aarambh Enterprise ("Company", "we", "us", "our"), you ("Client", "User", "you") agree to be fully bound by these Terms and Conditions ("Terms").

If you do not agree to these Terms in their entirety, you must immediately cease using our Website and services. Your continued use of our Website or engagement with our services constitutes your ongoing acceptance of these Terms.

These Terms constitute a legally binding agreement between you and Aarambh360 / Aarambh Enterprise. By proceeding with any service engagement, you confirm you have read, understood, and accepted all terms herein.

03 Services Offered

Aarambh360 provides the following categories of services, subject to these Terms and any separate service agreements:

  • Search Engine Optimization (SEO) — on-page, off-page, local, and technical SEO
  • Paid Advertising Management — Google Ads, Meta (Facebook & Instagram) Ads, YouTube Ads
  • Social Media Marketing — content creation, account management, community growth
  • Web Development — business websites, landing pages, e-commerce platforms
  • Software & CRM Development — custom software, automation, CRM systems
  • Brand & Business Consultancy — strategy, identity, positioning
  • Political Branding — digital brand building for politicians and public figures
  • Real Estate Digital Marketing — property lead generation, listing promotion, buyer outreach
  • Real Estate Facilitation Services — property listing support, buyer-seller connection, advisory (see Section 4)
  • Content Creation — copywriting, photography briefs, video scripting

All services are subject to a separate service agreement, proposal, or scope of work document. In the event of any conflict between these Terms and a specific service agreement, the specific service agreement shall prevail.

04 Realtor Services — Important Disclaimer

⚠️ IMPORTANT NOTICE REGARDING REAL ESTATE FACILITATION: Aarambh360 / Aarambh Enterprise is currently NOT a licensed real estate agent or RERA-registered broker under the Real Estate (Regulation and Development) Act, 2016 (RERA) or any other applicable Indian real estate regulatory framework. Our real estate registration and licensing process is actively in progress.

Until formal licensing and registration is obtained and confirmed, our real estate-related activities are strictly limited to the following:

  • Digital Marketing for Real Estate: Running paid advertising campaigns (Google Ads, Meta Ads), SEO, social media marketing, and content creation for builders, developers, and property owners — which does not require a real estate licence.
  • Property Listing Promotion: Assisting with the creation and digital promotion of property listings on behalf of registered developers, licensed agents, or property owners.
  • Lead Generation & CRM: Generating and managing property buyer inquiries on behalf of the property owner or developer client.
  • Advisory & Facilitation (Non-Brokerage): Providing general market information, property presentation guidance, and buyer-seller introduction services — strictly as an information and introductory service, not as a licensed real estate broker or agent.

📋 Our realtor licensing and RERA registration is currently in process. Once obtained, we will update this section accordingly and expand our formal real estate brokerage services. Clients engaging our real estate facilitation services acknowledge and accept this current status and agree that such services are advisory and introductory in nature only.

Aarambh360 does not provide legal advice on property transactions, does not hold client funds or property deposits, and does not execute legal property agreements on behalf of any party. All formal legal property transactions must be conducted through appropriately licensed and RERA-registered professionals.

By engaging our real estate-related services, you acknowledge that you have read and understood this disclaimer and accept the current limitations of our real estate facilitation services.

05 Eligibility

Our services are available to:

  • Individuals who are 18 years of age or older
  • Legally registered businesses, companies, partnerships, and sole proprietorships operating in India
  • Clients who have the legal authority to enter into binding contracts

By engaging our services, you represent and warrant that you meet all eligibility requirements. We reserve the right to refuse service to anyone at our sole discretion.

06 Client Obligations

As a client of Aarambh360, you agree to:

  • Provide accurate, complete, and truthful information required for service delivery
  • Provide timely approvals, feedback, and materials as required to fulfil your service scope
  • Ensure that all content, logos, trademarks, and materials you provide to us do not infringe the intellectual property rights of any third party
  • Use our services only for lawful purposes and not in violation of any applicable Indian or international laws
  • Not use our services to promote illegal activities, hate speech, discrimination, or any content that violates applicable laws or platform policies
  • Pay all agreed fees on time in accordance with the payment schedule in your service agreement
  • Maintain the confidentiality of any account credentials, login details, or access information we provide to you
  • Promptly inform us of any material changes to your business that may affect service delivery

07 Payment Terms

All payment terms are specified in individual service agreements or proposals. General payment terms include:

  • All fees are quoted and payable in Indian Rupees (INR) unless otherwise specified in writing
  • Service fees are typically due in advance or as per the payment schedule in your service agreement
  • Ad spend / media budgets are separate from our management fees and are the sole responsibility of the client
  • Late payments may attract a delay fee as specified in your service agreement
  • All payments are non-refundable unless explicitly stated otherwise in your service agreement or required by applicable law
  • We reserve the right to pause or suspend services in the event of non-payment until outstanding amounts are cleared
  • Invoices are subject to applicable GST as per Indian tax regulations

Ad spend budgets paid directly to Google, Meta, or any third-party advertising platform are not part of Aarambh360's fees and are non-refundable once deployed. Aarambh360 is not responsible for refunds of any amounts paid directly to third-party platforms.

08 Intellectual Property

Our Intellectual Property: All content on this Website — including text, graphics, logos, icons, images, and software — is the property of Aarambh360 / Aarambh Enterprise and is protected by applicable Indian copyright and intellectual property laws. No content may be reproduced, distributed, or used without our prior written consent.

Your Intellectual Property: You retain ownership of all content, logos, trademarks, and materials you provide to us. By providing materials to us, you grant us a non-exclusive, royalty-free licence to use such materials solely for the purpose of delivering your contracted services.

Deliverables: Upon full payment of all fees, ownership of final deliverables (websites, creative assets, written content) created specifically for you transfers to you. Proprietary tools, frameworks, processes, and templates developed by Aarambh360 remain our exclusive property regardless of payment.

Portfolio Rights: We reserve the right to display work created for you in our portfolio and marketing materials unless you explicitly request confidentiality in writing prior to project commencement.

09 No Guarantee of Results

⚠️ Aarambh360 does not guarantee specific marketing results, rankings, lead volumes, revenue outcomes, or return on investment. Digital marketing results depend on numerous factors outside our control including market conditions, competition, platform algorithm changes, and client-side factors.

All case studies, result statistics, and performance figures mentioned on our Website represent past results achieved for specific clients under specific conditions and are not a guarantee of similar results for any other client. We commit to applying our best expertise, strategies, and effort to deliver maximum value within your budget and market conditions.

With respect to real estate facilitation services specifically: we do not guarantee property sales, buyer conversions, or deal closure outcomes. All property transactions depend on multiple independent factors including market conditions, property pricing, buyer financing, and legal due diligence.

10 Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or sensitive information shared during the course of the service engagement. This includes:

  • Business strategies, marketing data, and campaign performance information
  • Political strategy, campaign plans, and constituent data (for political branding clients)
  • Financial information and business projections
  • Client lists, customer data, and proprietary business processes

Confidentiality obligations survive the termination of the service agreement for a period of two (2) years. We will not disclose confidential client information to any third party without your prior written consent, except as required by law.

11 Limitation of Liability

To the maximum extent permitted by applicable Indian law:

  • Aarambh360's total liability for any claim arising from our services shall not exceed the total fees paid by you for the specific service giving rise to the claim in the three (3) months preceding the claim
  • We shall not be liable for any indirect, incidental, consequential, special, or punitive damages including loss of profits, loss of revenue, loss of data, or loss of business opportunity
  • We are not liable for any losses arising from third-party platform changes, algorithm updates, service outages, or policy changes by Google, Meta, or any other platform
  • We are not liable for any losses arising from your failure to provide accurate information, timely approvals, or required materials
  • We are not liable for any property transaction outcomes in relation to our real estate facilitation services, given our current non-licensed status as described in Section 4

12 Termination

Either party may terminate a service agreement by providing written notice as specified in the service agreement (typically 30 days). Upon termination:

  • All outstanding fees for work completed become immediately payable
  • Fees for the current billing period are non-refundable unless otherwise agreed in writing
  • We will transfer all deliverables completed up to the termination date upon receipt of full payment
  • Both parties continue to be bound by confidentiality obligations post-termination

We reserve the right to immediately terminate services without notice if you breach these Terms, engage in illegal activity, fail to pay outstanding fees, or use our services for purposes that violate applicable laws or platform policies.

13 Third-Party Platforms & Services

Our services involve the use of third-party platforms including but not limited to Google, Meta (Facebook/Instagram), LinkedIn, YouTube, Swiggy, Zomato, 99acres, MagicBricks, and Housing.com. We are not affiliated with, endorsed by, or responsible for these platforms.

These platforms have their own terms of service and policies that apply independently. Changes to their policies, algorithms, or services may affect campaign performance, and we bear no liability for such changes. You are responsible for maintaining compliance with the terms of any third-party platform through which we deliver services on your behalf.

14 Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Kolkata, West Bengal, India.

Before initiating formal legal proceedings, both parties agree to first attempt to resolve any dispute through good-faith negotiation for a period of thirty (30) days. If unresolved, disputes may be referred to arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Kolkata.

15 Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via our Website or email. Continued use of our services after changes are posted constitutes your acceptance of the revised Terms. We recommend reviewing these Terms periodically.

In particular, Section 4 (Realtor Services Disclaimer) will be updated as and when our real estate licensing and RERA registration is completed and confirmed.
